These General Terms and Conditions of Sale govern the contractual relationship between SARL Sandrine CHAPPAZ, whose registered office is located at 403 Chemin de la Seyta 38380 Saint Laurent du Pont, and the customer, a non-commercial natural person, of the Shop on the website www.chocolatschappaz.com.
Sandrine CHAPPAZ is a SARL, registered with the Grenoble Business Register under number 793 444 902, represented by its managers, Sandrine CHAPPAZ and Pierre CHAPPAZ.
The validation of an order by a customer entails acceptance of all these General Terms and Conditions of Sale.
They shall prevail over any other conditions appearing in any other document, unless prior, express and written derogation.
The SANDRINE CHAPPAZ brand is registered in France and internationally for chocolates and confectionery.
The online commerce service, distance selling of SANDRINE CHAPPAZ products, offered by SARL Sandrine CHAPPAZ is exclusively intended for consumers to satisfy their personal needs, to the exclusion of any purchase for resale.
1. Products
SARL Sandrine CHAPPAZ reserves the right at any time and without notice to add or remove products from its catalogue.
Product photos are merely indicative; the packaging, appearance and composition of products may vary according to their seasonality and the manufacturing processes implemented.
Chocolates and other confectionery are offered in ranges, and it is possible that in an assorted box one variety may be replaced by another, depending on availability and seasonality in particular.
The customer accepts this principle and may not lodge any complaint in this regard.
2. Product Availability
The customer's order will be fulfilled within the limit of stocks available at our production site.
It remains that chocolate and confectionery are fragile products and SARL Sandrine CHAPPAZ reserves the right not to register orders for shipment during certain periods of the year and particularly during periods when external temperatures are high.
Price - Payment
The prices displayed on the website www.chocolatschappaz.com and in its online shop are expressed in Euros.
Transport is not included in the price indicated on the "product" sheet.
The total price indicated in the summary of your order is the final price.
This price includes the price of the total order with the detail of each product and packaging and shipping costs.
All prices are indicated including VAT (All Taxes Included).
Payment of the price is made in full at the time of order, by credit card.
The sale is only completed upon full payment of the price.
3. Order
- Registration of an order on the shop of the website www.chocolatschappaz.com and its validation by the customer takes place when the customer clicks on the "Pay for order" button on the "Summary & Payment" page. In addition to acceptance of the order content, this registration implies acceptance of all these General Terms and Conditions of Sale and constitutes proof of the order date. SARL Sandrine CHAPPAZ confirms acceptance of the customer's order by email to the address provided by the customer.
- SARL Sandrine CHAPPAZ reserves the right to refuse or cancel any new order from a customer with whom a dispute exists.
Orders received via the internet after payment acceptance by the credit card center are prepared and shipped within 3 business days following payment.
- When placing an order, the customer provides at their entire and sole responsibility the following information: first and last name, postal address, email address, telephone number concerning them and the same if their order is to be shipped to a third party.
- ATTENTION: Orders indicating a PO Box address cannot be accepted.
- In case of error in the destination address details, SARL Sandrine CHAPPAZ cannot be held responsible for delivery failure. In this case, as in case of order cancellation by the customer after shipment, the cost of the order will not be refunded to the customer by SARL Sandrine CHAPPAZ.
- The invoice corresponding to the order can be downloaded from the customer account on the website www.chocolatschappaz.com.
- The data recorded by the SARL Sandrine CHAPPAZ computer system constitutes proof of all transactions made between SARL Sandrine CHAPPAZ and its customers.
4. Delivery
Delivery Zone
The delivery zone includes Metropolitan France only and EU countries.
Delivery Rates
The amount of delivery charges, including packaging and shipping fees, are partially borne by the customer. It is invoiced in addition to the product sales price. The amount of delivery charges is determined based on the weight of the items ordered, products are delivered by postal parcels or by courier if postal service is temporarily unavailable.
Timeframes
Shipments take place from Tuesday to Friday inclusive.
Delivery timeframes are as follows:
France: 3 to 5 days via DPD home delivery or DPD parcel pick-up point, excluding Sundays and public holidays.
These timeframes are given for information only. No compensation can be claimed in the event of a possible delivery delay.
We cannot in any way be held responsible for damage that may occur to products if the parcel has been opened during shipment, or in the event of the recipient's absence when the parcel is dropped off.
The delivery deadline cannot be guaranteed during holiday periods such as Christmas, Easter, Valentine's Day or Mother's Day, etc. During these periods, late delivered orders cannot benefit from a credit note.
Right of Withdrawal
Given the fragile and perishable nature of chocolates and similar products, the CUSTOMER cannot exercise the right of withdrawal, in accordance with the provisions of article L 121-20-2-3° of the Consumer Code.
The 7-day withdrawal period does not apply to contracts for the supply of perishable, food products, such as goods sold by SARL Sandrine CHAPPAZ.
However, to the extent possible, the CUSTOMER may modify or cancel their order provided that their order has not already been shipped. This assessment will be determined on a case-by-case basis. In the case of cancellation, no refund will be issued, but a credit note for the amount of the order will be credited to the CUSTOMER.
If the parcel has already been handed over to the courier, no modification or cancellation will be possible.
5. Warranty
The BEST BY date of our products is indicated on each package. Therefore, to best appreciate our products, we recommend choosing a delivery date as close as possible to your consumption date. SARL Sandrine CHAPPAZ guarantees the quality and freshness of its products provided they are stored in a cool place (between 18°C and 20°C) and dry, away from light.
6. Replacement and Refund
No returns, refunds or replacements will be accepted. No reservations can be made by the customer on criteria concerning taste, freshness and appearance of products.
In the event that deliveries cannot be made due to issues related to customs, strikes or damage or any other cause of force majeure under the responsibility of the courier, products will be replaced or refunded.
7. Liability
SARL Sandrine CHAPPAZ may be exonerated from all or part of its liability by providing proof that non-performance or poor performance of the contract is attributable either to the consumer, or to the unforeseen and insurmountable act of a third party to the contract, or to a case of force majeure.
SARL Sandrine CHAPPAZ cannot be held responsible for damages of any kind that may result from misuse of the items delivered to the customer.
In any case, the liability of SARL Sandrine CHAPPAZ will be limited to the amount of the order.
8. Applicable Law
These General Terms and Conditions of Sale are subject to French Law.
9. Disputes
The CUSTOMER and SARL Sandrine CHAPPAZ will always favor an amicable solution before any legal action.
In accordance with the provisions of the Consumer Code concerning "the consumer dispute mediation process", after contacting us and in the absence of a satisfactory response, you have the option to resort free of charge to a consumer mediation procedure with:

10. Personal Data Protection
Nominative information collected from the customer is necessary for processing the order, shipping the order and establishing the corresponding invoice.
Failure to provide such information will result in order rejection.
According to article 34 of the law of January 6, 1978, the customer has the right to access, modify, rectify and delete data concerning them.
